ReplyDeleteMany factors apply when answering this type of question. As a past Chief Steward for a large Mail Handler Local Union please consider these elements in answering this for yourself:
ReplyDelete* Typically, any absence of more than three days requires acceptable documentation. This is considered a national Past Practice.
* What is acceptable documentation? Anything that would be considered reasonable in past regional or national a arbitration or a local grievance that you can cite. You can cite winning grievances that do not specifically say they cannot be cited in future grievances.
* If you have a poor attendance record that has been documented AND management has non-challenged corrective actions for the same type of absence over a reasonably citable period of time against you or a period of time you have signed your agreement of, then you may have issues. See your union representative or file an EEO if you can make "like" examples of.
* Typically if you have reasonable or no prior attendance issues relating to attendance or you have a relating approved and current FMLA case you will be fine.
* please note I cannot provide legal advice and this should NOT be considered legal advice.
* Please also note each case should be approved or disapproved on its own merits or a lack of. All cases can be different in many ways.
* You should always request a union representative be present at any meeting with management to could possibly lead to discipline or corrective action. ALWAYS! Educate yourself and others on your Weingarten Rights (en.wikipedia.org/wiki/Weingarten_Rights).
